By downloading, installing, or using CheckBack ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

CheckBack is a personal safety application that allows users to set timed check-ins. If a user does not confirm their safety within the specified time, the App will notify designated emergency contacts with the user's last known location.

3. User Responsibilities

You agree to:

  • Provide accurate contact information for yourself and your emergency contacts
  • Obtain consent from any contacts you add to receive emergency notifications
  • Use the App only for lawful purposes
  • Keep your device charged and connected when using active check-ins
  • Not rely on this App as your sole means of emergency communication

4. Limitations of Service

CheckBack is designed to supplement, not replace, emergency services. You acknowledge that:

  • The App requires an active internet connection and location services to function
  • Location accuracy depends on your device's GPS and network conditions
  • Message delivery depends on network availability and third-party services
  • We cannot guarantee the App will function in all circumstances or emergencies
  • In life-threatening emergencies, always contact emergency services (911) directly

5. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF THE APP IS AT YOUR OWN RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHECKBACK AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF LIFE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

8. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new terms. We will notify users of significant changes through the App or via email.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these terms or for any other reason at our discretion.
